Liability Rights & ResponsibilitiesYou must report the injury to the place where the accident occurred as soon as possible. Have them fill out an incident report and get a copy. You must see a doctor as soon as possible for your injuries. Only a doctor can determine if the injuries are from your fall or pre-existing. If your injury is pre-existing, only a doctor can determine if it was aggravated or worsened by your fall. If you were injured due to someone else’s negligence you may be entitled to monetary recovery. However, the establishment would have to have known (or should have known) about the hazard, and failed to rectify the situation in a timely manner, in order to pursue a liability (or slip and fall) claim against them. If you see a hazard on the ground and fail to safely navigate your way around it. Then the law considers both you and the establishment to have equal knowledge and no one is liable.
